Policies
The following University of Kansas policies specifically relate to intellectual property and technology transfer issues.
- Kansas Board of Regents Intellectual Property Policy
This policy addresses the Kansas Board of Regents’ General Copyright Policy, Patent and Copyrightable Software Policy, Trademark Policy, and Institutional Procedures for the Kansas Regent Schools.
- Intellectual Property Policy for the Lawrence Campus
This policy applies to all full or part-time employees, including student employees, creating intellectual property related to the scope of their employment while under contract with the University on all of its campuses. The Kansas Board of Regents intellectual property policy is included.
- Handbook for Faculty and other Unclassified Staff
- Patent Policy
The KU Center for Technology Commercialization is responsible for procuring and administering patents on inventions that have resulted from research conducted at the University of Kansas. The Kansas Board of Regents patent policy is included.
- Institutional Conflict of Interest Policy
The purpose of this policy is to mitigate institutional conflicts (at each Research Foundation and the University) and to avoid the creation of other personal conflicts on the Edwards and Lawrence campuses and Medical Center and Wichita campuses with regard to a Research Foundation’s equity holdings.
- Management of Inventor Conflict of Interest Policy
To ensure that the mission of the University is not compromised and that research integrity and objectivity is held to the highest standards on its campuses (Edwards and Lawrence and Medical Center and Wichita), an employee’s outside activities with regard to University research and transfer of the University’s technology must be disclosed, reviewed and managed with appropriate oversight.
- Technology Transfer Revenue Distribution Policy
In accordance with the Regents’ Intellectual Property policy, the Distribution Formula will be applied when any revenue is obtained by or on behalf of the University of Kansas (Edwards and Lawrence campuses and Medical Center and Wichita campuses) from the development or assignment of any patent or from royalties, license fees or other charges based on any patent or copyrightable software. Revenue sharing shall begin only after costs are recouped.
- Employment of Students and Residents in Faculty-Owned Businesses Policy
Students on the Edwards and Lawrence campuses and Medical Center and Wichita campuses may be employed by companies in which faculty members hold an ownership interest. Prior to such employment, the student, faculty member, the chair of the student’s department, the chair of the graduate studies committee and a company representative must sign a disclosure agreement.
Otherwise, students may perform research benefiting a faculty owned company only pursuant to a sponsored research agreement or formal internship agreement through the University. A student may not be employed by a company in which a faculty member (or faculty member's spouse or household member) has an ownership interest in that company if (a) the student is enrolled in a course taught by the faculty member, (b) the faculty member is a member of the student's thesis or dissertation committee, or (c) the faculty member is the student's advisor or the director of his or her thesis or dissertation research.
